SPA suspends seven Brazil licences for negligence of tech duties

In a decisive move that underscores the Brazilian Secretariat of Prizes and Betting (SPA)’s commitment to maintaining a secure and regulated online gambling environment, seven licenses were suspended in what marks the authority’s most stringent enforcement action yet. This development follows a tumultuous week that saw Brazil’s emerging online gambling market come under close scrutiny.

At the heart of this regulatory storm is the failure of these operators to submit their cybersecurity evaluation reports timely, a requirement clearly outlined in Article 8 of Ordinance SPA/MF No. 722/2024. The repercussions of this oversight have been swift and significant, with the suspension coming into effect at the close of May.

Among those affected are prominent names within Brazil’s betting landscape, including PixBet, known for its sponsorship deal with Flamengo FC, and BETesporte, which backs Sao Paulo’s Paulista and Rio de Janeiro’s Carioca state football championships. The SPA has mandated a temporary halt on the online activities of these seven entities pending a thorough compliance review.

The full list of operators facing suspension reads as follows:

– Bell Ventures Digital Ltda – brand: BandBet
– Bet.Bet Soluções Tecnológicas S.A. – brands: Bet.Bet, DonaldBet
– Betesporte Apostas On Line Ltda – brands: BETesporte, Lance de Sorte
– EA Entretenimento e Esportes Ltda – brands: Bateu Bet, HanzBet, Esportiva Bet
– Logame do Brasil Ltda – brands: LíderBet, GeralBet, B2xBet
– PixBet Soluções Tecnológicas Ltda – brands: PixBet, FlaBet, Bet da Sorte
– SorteNaBet Gaming Brasil S.A. – brands: SorteNaBet, Betou, BetFusion

These operators are now barred from conducting any betting operations, accepting deposits or registering new users in Brazil until they achieve compliance by furnishing the requisite cybersecurity certifications as per SPA’s standards.

The Ministry of Finance has voiced its support for these measures, emphasizing their importance in protecting Brazilian consumers and ensuring that licensed entities uphold robust cyber-resilience practices.

As sanction proceedings kick off, non-compliance could escalate to daily fines amounting to R$40,000 alongside more severe consequences such as permanent license revocation.

Insights from legal experts contacted by SBC Noticias Brazil highlight the gravity of SPA’s actions given the stature and commercial influence of affected brands like PixBet and BETesporte. Tax lawyer Kamilla Yazawa remarked on this as a crucial juncture for Brazil’s regulation landscape where operators must align strictly with legal mandates enforced by SPA.

Adding another layer to this regulatory saga is recent Senate approval for Bill 2,985/2023 aiming at establishing a federal framework specifically for gambling advertising—a move separate from the Bets regime. While intended to safeguard interests such as sports integrity and reduce youth exposure to gambling ads, there’s growing concern among over 50 football clubs about potential financial repercussions estimated at R$1.6bn annually ($285m). This potential loss points towards an uncertain future concerning sponsorship deals amidst fears of unlicensed markets gaining traction due to restrictive advertising laws.

Yet despite these apprehensions, legislative momentum appears strong with widespread Senate backing for unique oversight on gambling advertisements driven by concerns over gambling sponsorships’ pervasive effects on football culture among other issues. With anticipated Chamber discussions looming ahead for this bill whose scheduling remains undetermined, stakeholders across both gambling and sports sectors are bracing for impact as they navigate through these evolving regulatory landscapes in Brazil.
